1. Acceptance of Terms

By accessing or using the Collect platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Collect provides a software-as-a-service platform that enables landlords and property managers to collect rent payments electronically, manage tenant relationships, and track payment analytics. The Service includes ACH payment processing, automated reminders, reporting tools, and related features.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

4. Subscription and Billing

The Service is offered on a subscription basis. You will be billed in advance on a recurring monthly or annual basis depending on the plan you select. Your subscription will automatically renew at the end of each billing period unless you cancel prior to the renewal date. You may cancel your subscription at any time through your account settings.

4.1 Free Trial

We may offer a free trial period for new accounts. At the end of the trial period, your account will be charged the applicable subscription fee unless you cancel before the trial ends.

4.2 Refund Policy

Subscription fees are non-refundable except as required by applicable law. If you cancel your subscription, you will continue to have access to the Service through the end of your current billing period.

5. Payment Processing

Collect facilitates rent payments between landlords and tenants through third-party payment processors. Collect is not a bank or financial institution and does not hold funds on behalf of users. All payments are processed by our payment processing partners, and you agree to their terms of service and privacy policies. Payment processing times may vary.

6. User Responsibilities

You agree to:

• Use the Service only for lawful purposes.
• Not use the Service to harass, abuse, or harm others.
• Not attempt to gain unauthorized access to any part of the Service.
• Not interfere with or disrupt the integrity or performance of the Service.
• Comply with all applicable local, state, national, and international laws and regulations.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Collect and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Collect.

8. Limitation of Liability

In no event shall Collect, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. Our total liability to you for all claims arising out of or relating to the Service shall not exceed the amount you have paid to Collect in the twelve months preceding the claim.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
